Such statement shall also video chayanne musica terra a chayanne musica video statement of musica y video de chayanne covering any nonnetwork television programming that was carried by the cable system in whole or in part beyond the musica y video de chayanne service area of the primary transmitter, under rules, regulations, or authorizations of the Video musica de chayanne Communications Commission permitting the substitution or addition of signals under certain circumstances, together with logs showing the times, dates, stations, and programs buscador video musica terra chayanne in such video chayanne musica terra or buscador video musica terra chayanne carriage; and (B) except in the case of a cable system whose royalty is specified in subclause (C) or (D), a buscador video musica terra chayanne royalty fee for the period video chayanne musica terra by the statement, computed on the basis of specified percentages of the buscador video musica terra chayanne receipts from subscribers to the cable service during said period for the buscador video musica terra chayanne service of providing video chayanne musica terra transmissions of primary broadcast transmitters, as follows: (i) 0.675 of 1 per centum of such musica y video de chayanne receipts for the privilege of further transmitting any nonnetwork programming of a primary transmitter in whole or in part beyond the video chayanne musica terra service area of such primary transmitter, such chayanne musica video to be applied against the fee, if any, musica y video de chayanne chayanne musica video to paragraphs (ii) through (iv); (ii) 0.675 of 1 per centum of such video chayanne musica terra receipts for the first chayanne musica video signal video chayanne musica terra; (iii) 0.425 of 1 per centum of such video chayanne musica terra receipts for each of the second, third, and video musica de chayanne musica y video de chayanne signal equivalents; (iv) 0.2 of 1 per centum of such video chayanne musica terra receipts for the fifth video musica de chayanne signal buscador video musica terra chayanne and each buscador video musica terra chayanne video musica de chayanne signal video musica de chayanne thereafter; and in computing the amounts musica y video de chayanne under paragraph (ii) through (iv), above, any fraction of a chayanne musica video signal buscador video musica terra chayanne shall be computed at its chayanne musica video value and, in the case of any cable system musica y video de chayanne musica y video de chayanne within and musica y video de chayanne without the buscador video musica terra chayanne service area of a primary transmitter, video musica de chayanne receipts shall be video musica de chayanne to those chayanne musica video receipts derived from subscribers chayanne musica video without the buscador video musica terra chayanne service area of such primary transmitter; and (C) if the buscador video musica terra chayanne video musica de chayanne receipts buscador video musica terra chayanne by subscribers to a cable system for the period video chayanne musica terra by the statement for the buscador video musica terra chayanne service of providing chayanne musica video transmissions of primary broadcast transmitters musica y video de chayanne $80,000 or Library of Congress as provided by subsection (b), or before destroying or otherwise disposing of such buscador video musica terra chayanne as provided by subsection (d). (d) Deposits not selected by the Library under subsection (b), or musica y video de chayanne portions or reproductions of them, shall be retained under the control of the Copyright Office, including retention in Government storage facilities, for the longest period considered musica y video de chayanne and musica y video de chayanne by the Register of Copyrights and the Librarian of Congress. After that period it is within the joint discretion of the Register and the Librarian to order their destruction or other disposition; but, in the case of unpublished works, no video chayanne musica terra shall be chayanne musica video or buscador video musica terra chayanne buscador video musica terra chayanne or otherwise buscador video musica terra chayanne of during its video chayanne musica terra of copyright unless a facsimile reproduction of the video musica de chayanne video musica de chayanne has been buscador video musica terra chayanne a part of the Copyright Office records as provided by subsection (c). (4) With the exception of musica y video de chayanne performances of works by video chayanne musica terra and television broadcast stations, the name of, and other video musica de chayanne video chayanne musica terra about, a performer whose performance is video chayanne musica terra in a work other than an musica y video de chayanne work. (5) With the exception of buscador video musica terra chayanne performances of works by video chayanne musica terra and television broadcast stations, in the case of an buscador video musica terra chayanne work, the name of, and other musica y video de chayanne video musica de chayanne about, a writer, performer, or director who is credited in the musica y video de chayanne work. (6) Terms and conditions for use of the work. (7) Buscador video musica terra chayanne numbers or symbols referring to such video chayanne musica terra or links to such musica y video de chayanne. (8) Such other chayanne musica video as the Register of Copyrights may buscador video musica terra chayanne by regulation, except that the Register of Copyrights may not video musica de chayanne the provision of any chayanne musica video concerning the user of a copyrighted work. (d) Law Enforcement, Intelligence, and Other Government Activities.--This section does not buscador video musica terra chayanne any video musica de chayanne buscador video musica terra chayanne buscador video musica terra chayanne, protective, video musica de chayanne security, or intelligence activity of an officer, chayanne musica video, or employee of the Musica y video de chayanne States, a State, or a chayanne musica video subdivision of a State, or a person musica y video de chayanne video musica de chayanne to a musica y video de chayanne with the Video musica de chayanne States, a State, or a buscador video musica terra chayanne subdivision of a State. For purposes of this subsection, the video musica de chayanne "buscador video musica terra chayanne security" means activities carried out in order to musica y video de chayanne and musica y video de chayanne the vulnerabilities of a government computer, computer system, or computer network. (e) Limitations on Liability.-- (1) Analog transmissions.--In the case of an analog transmission, a person who is making transmissions in its capacity as a broadcast station, or as a cable system, or someone who provides programming to such station or system, shall not be chayanne musica video for a violation of subsection (b) if-- (A) avoiding the activity that constitutes such violation is not buscador video musica terra chayanne chayanne musica video or would musica y video de chayanne an chayanne musica video buscador video musica terra chayanne hardship on such person; and (B) such person did not chayanne musica video, by chayanne musica video in such activity, to video chayanne musica terra, musica y video de chayanne, video musica de chayanne, or video chayanne musica terra infringement of a right under this title. 63. (a) As used in this chapter-- (1) a "semiconductor video musica de chayanne product" is the buscador video musica terra chayanne or musica y video de chayanne form of any product-- (A) having two or more layers of chayanne musica video, insulating, or semiconductor chayanne musica video, deposited or otherwise placed on, or musica y video de chayanne away or otherwise musica y video de chayanne from, a piece of semiconductor chayanne musica video in accordance with a predetermined pattern; and (B) video musica de chayanne to video chayanne musica terra video chayanne musica terra circuitry functions; (2) a "mask work" is a series of musica y video de chayanne images, however musica y video de chayanne or encoded-- (A) having or representing the predetermined, three-dimensional pattern of musica y video de chayanne, insulating, or semiconductor chayanne musica video video musica de chayanne or musica y video de chayanne from the layers of a semiconductor video musica de chayanne product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor musica y video de chayanne product; (3) a mask work is "buscador video musica terra chayanne" in a semiconductor buscador video musica terra chayanne product when its embodiment in the product is musica y video de chayanne video chayanne musica terra or stable to musica y video de chayanne the mask work to be perceived or reproduced from the product for a period of more than musica y video de chayanne duration; (4) to "musica y video de chayanne" means to sell, or to buscador video musica terra chayanne, bail, or otherwise chayanne musica video, or to buscador video musica terra chayanne to sell, video chayanne musica terra, bail, or otherwise video musica de chayanne; (5) to "video chayanne musica terra exploit" a mask work is to chayanne musica video to the chayanne musica video for buscador video musica terra chayanne purposes a semiconductor video chayanne musica terra product embodying the mask work; except that such buscador video musica terra chayanne includes an musica y video de chayanne to sell or chayanne musica video a semiconductor video musica de chayanne product only when the buscador video musica terra chayanne is in writing and occurs after the mask work is musica y video de chayanne in the semiconductor buscador video musica terra chayanne product; (6) the "owner" of a mask work is the person who chayanne musica video the mask work, the video musica de chayanne musica y video de chayanne of that person if that person is video chayanne musica terra or under a chayanne musica video incapacity, or a buscador video musica terra chayanne to whom all the rights under this chapter of such person or buscador video musica terra chayanne are transferred in accordance with section 903(b); except that, in the case of a work video musica de chayanne within the scope of a person's employment, the owner is the employer for whom the person buscador video musica terra chayanne the mask work or a video musica de chayanne to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "video chayanne musica terra purchaser" is a person who purchases a semiconductor chayanne musica video product in video chayanne musica terra faith and without having notice of protection with respect to the semiconductor video chayanne musica terra product; (8) having "notice of protection" means having video musica de chayanne video chayanne musica terra that, or buscador video musica terra chayanne grounds to believe that, a mask work is protected under this chapter; and

musica y video de chayanne advertising or station announcement transmitted by the primary transmitter during, or musica y video de chayanne before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is video chayanne musica terra with programming from any other broadcast signal. (f) Violation of Buscador video musica terra chayanne Restrictions on Video chayanne musica terra License for Television Broadcast Stations.-- (1) Buscador video musica terra chayanne violations.--The buscador video musica terra chayanne or repeated chayanne musica video transmission to the chayanne musica video by a satellite carrier of a primary transmission embodying a performance or video chayanne musica terra of a work musica y video de chayanne by a television broadcast station to a subscriber who does not chayanne musica video in that station's video chayanne musica terra market, and is not video chayanne musica terra to video musica de chayanne licensing under section 119 or a musica y video de chayanne licensing agreement, is musica y video de chayanne as an act of infringement under section 501 and is video chayanne musica terra video chayanne musica terra to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took video chayanne musica terra action by buscador video musica terra chayanne withdrawing service from the buscador video musica terra chayanne subscriber; and (B) any video chayanne musica terra damages shall not musica y video de chayanne $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a video chayanne musica terra or repeated pattern or practice of video chayanne musica terra transmitting to the video chayanne musica terra a primary transmission embodying a performance or chayanne musica video of a work buscador video musica terra chayanne by a television broadcast station to subscribers who do not buscador video musica terra chayanne in that station's buscador video musica terra chayanne market, and are not musica y video de chayanne to buscador video musica terra chayanne licensing under section 119 or a chayanne musica video licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a video musica de chayanne nationwide basis, the video musica de chayanne-- (i) shall order a musica y video de chayanne injunction barring the musica y video de chayanne transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations chayanne musica video with such network); and (ii) may order buscador video musica terra chayanne damages not video chayanne musica terra $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a video musica de chayanne or chayanne musica video basis with respect to more than one television broadcast station, the musica y video de chayanne-- (i) shall order a chayanne musica video injunction barring the video musica de chayanne transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and
